5G Statement

Michigan's Small Cell Wireless Communications Facilities Deployment Act, PA 365 of 2018, MCL 160.1301 et seq. allows wireless service providers access to City of Ann Arbor rights-of-way, including the ability to attach Small Cell Wireless Facilities (“Small Cells") to poles and structures, and further provides for City regulation of the activities of wireless services providers collocating in the rights-of-way. But the City's authority to regulate Small Cells is significantly limited by the Act.  For example, the City cannot prohibit a carrier from collocating its Small Cells in a certain area, nor can it prohibit any provider's technology, such as 5G.
